Oklahoma sales tax nexus for online sellers comes from a physical presence in Oklahoma, or from $100,000 or more of taxable sales into Oklahoma in the previous or current calendar year. There is no transaction test. Once you have nexus, register with the Oklahoma Tax Commission and collect the 4.5% state rate plus city and county taxes.

What is the Oklahoma sales tax rate?

The state rate is 4.5%. Cities and counties add their own taxes, which are often larger than the state tax: Oklahoma City's combined rate is 8.625%, and some places are above 10%. Tax is charged at the rate for the delivery address. Since August 29, 2024, the state rate on groceries is 0%, though local taxes still apply to them. Software accessed online and digital products are generally not taxed.

When does an online seller have to collect in Oklahoma?

You must collect if you have a physical presence in Oklahoma, such as staff, an office or inventory, or if your taxable sales into Oklahoma are $100,000 or more in the previous or current calendar year. There is no transaction-count test. Sales made through a marketplace that collects the tax are not counted towards your own figure. A seller who reaches the threshold starts collecting from the first day of the next calendar month.

What if you sell on Amazon, eBay or Etsy?

Oklahoma requires marketplace facilitators to collect and remit sales tax on the sales they facilitate, so you do not collect on those orders. Your own website and other direct channels remain your responsibility. See marketplace facilitator laws.

How are returns filed?

Returns are filed through the Oklahoma Taxpayer Access Point and are due by the 20th of the month after the period. Most sellers file monthly; the smallest can file less often. One return covers state, city and county taxes, reported by jurisdiction.

The local part is nearly half the total, and it differs from city to city and county to county. A store that charged only the state rate would under-collect on almost every order, so set rates by delivery address.

How are groceries taxed now?

Oklahoma removed its 4.5% state sales tax on groceries from August 29, 2024. City and county taxes still apply, so a grocery order is taxed at the local rate only. Prepared food, alcohol and some other items remain taxable in full. Food sellers need to separate these categories in their store's tax settings.
