What are the 1099 deadlines in 2027?
| Form, for 2026 payments | To the recipient | To the IRS |
|---|---|---|
| 1099-NEC | February 1, 2027 | February 1, 2027, paper or electronic |
| 1099-MISC | February 1, 2027, or February 16 if reporting certain payments in boxes 8 or 10 | March 1, 2027 on paper, March 31, 2027 electronically |
| 1099-K, issued by payment companies | February 1, 2027 | March 1, 2027 on paper, March 31, 2027 electronically |
January 31 and February 28, 2027 both fall on a Sunday, which is why those deadlines move to the next business day.
How much are the penalties?
For information returns required to be filed in 2027, the penalty per form depends on when the correct form is filed:
| When the correct form is filed | Penalty per form |
|---|---|
| Within 30 days after the due date | $60 |
| More than 30 days late, by August 1 | $130 |
| After August 1, or not filed | $340 |
| Intentional disregard | At least $680, with no annual maximum |
Two separate penalties can apply to the same form: one for not filing a correct return with the IRS, and one for not furnishing a correct statement to the recipient. Annual maximums apply, lower for businesses with average annual gross receipts of $5 million or less, except for intentional disregard. The same amounts cover wrong information, such as an incorrect amount or taxpayer number, and paper filing when electronic filing was required.
Can you get more time?
For most information returns, Form 8809 gives an automatic 30-day extension for filing with the IRS if submitted by the original due date. Form 1099-NEC is the exception: its extension is granted only for specific reasons, such as a catastrophic event. Extensions for sending recipient copies are requested separately and are not automatic.
When must you file electronically?
If you file 10 or more information returns of all types in total for the year, including Forms W-2, you must file them electronically. The IRS's free Information Returns Intake System lets small businesses file 1099s online without software.
Paper filers send each form type with its own Form 1096. Rents, royalties and other payments go on Form 1099-MISC.
What should you do if you have missed the deadline?
File as soon as possible
Filing within 30 days keeps the penalty at the lowest level.
Send recipients their copies
They need them to file their own returns.
Correct errors quickly
A corrected form filed within 30 days of the due date also falls into the lowest tier.
Ask for relief if you had reasonable cause
When a penalty notice arrives, the IRS can remove penalties where the failure was due to events beyond your control and you acted responsibly.
Are small errors penalized?
A safe harbor covers minor dollar errors. If an amount is wrong by no more than $100, or by no more than $25 for tax withheld, the form is generally treated as correct and no correction is required, unless the recipient asks for a corrected form.
The step-by-step process is in how to correct a 1099.
How do you avoid the penalties?
- Collect Forms W-9 when contractors start, not in January. See Form W-9.
- Track payments by contractor throughout the year. See how to pay contractors and file their 1099s.
- Put February 1 in the calendar in early December, alongside W-2s. See US business tax deadlines.
